This is so because their employment agreement is provided by the shipping company or vessel owner, in accordance with both the International Labour Organisation and the Maritime Labour Convention 2006.

Two authorities regulate the employment agreement of a seafarer: ILO and MLC..As such, the shipping company or vessel owner is saddled with the responsibility of ensuring that the seafarer employment agreement is in compliance with applicable laws and regulations, and that the terms and conditions are rightly stated, including the working conditions of employment, in addition to wages, benefits, working hours, and so on.

SEAFARER EMPLOYMENT AGREEMENT

This Seafarer Employment Agreement is made and entered into on 30th April, 2021, by and between SEATIME INC.

EMPLOYMENT

The Company agrees to employ the seafarer as Captain on board the vessel Maryland for a period of 18 months.

DUTIES AND RESPONSIBILITIES

The Seafarer shall perform his duties and responsibilities as Captain in accordance with the Company’s instructions and the Vessel’s requirements.

WAGES AND BENEFITS

The company shall pay the seafarer a monthly wage of N2,000,000 and provide benefits as follows:

Overtime pay

Leave entitlement

Medical benefits

Life insurance

WORKING HOURS AND LEAVE

The Seafarer shall work the stipulated number of hours per week and be entitled to the prescribed number of days of leave per year.

TERMINATION This agreement may be terminated by either party with 28 days’ written notice.

DISCIPLINARY PROCEDURE

The Company shall follow a fair and reasonable disciplinary procedure in the event of any misconduct or poor performance by the Seafarer.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties supersedes all prior negotiations, understandings, and agreements.
